I'm not sure, I asked on discord and @Strategic Sage that it should be possible only with sidekick

That's because that's how it was explained to me. If it's by design that they can build even as Empire, then I don't understand how Sidekick is different from Empire but I also definitely don't think anyone should worry much about it.

The code right now says "Empire is the same as sidekick, except you get your own starting planet".

I think it's going to stay that way, since I have no interest in changing it at the moment
